Acceptance of Terms
Alif Global Tours & Travels (hereinafter referred to as “the Company,” “We,” “Us,” or “Alif Global”), including its subsidiary Alif Education & Immigration Consultancy, provides its services to you (the “Client” or “User”) subject to the following Terms of Service (“Terms”).
By accessing our website, signing a service agreement, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.
Contracting Entity & Jurisdiction
To ensure legal clarity for our international clients, the specific contracting entity depends on your location and the service engaged:
- Bangladesh & Rest of World (excluding North America): You are contracting with Alif Global Tours & Travels, governed by the laws of Bangladesh. Disputes shall be subject to the exclusive jurisdiction of the courts in Dhaka.
- North America (USA & Canada): You are contracting with Alif Global Tours & Travels (USA Branch), governed by the laws of the State of New York, USA. Disputes shall be subject to the exclusive jurisdiction of the courts in Erie County, New York.
Scope of Services & Agency Status
A. Tourism & Travel Services
Alif Global acts solely as an intermediary agent for third-party service providers, including but not limited to airlines, hotels, transport operators, and cruise lines.
- No Control: We do not own or operate these third-party services. We are not liable for their acts, omissions, negligence, bankruptcy, or service failures.
- Itinerary Changes: Schedules are subject to change by operators. We will make reasonable efforts to accommodate changes but are not liable for costs incurred due to third-party delays.
B. Education & Immigration Consultancy
We provide advisory services based on current laws and regulations.
- Advisory Role Only: We are consultants, not government officials. We assist in preparing applications but have no authority to grant visas, permits, or admissions.
- Policy Changes: Immigration laws and university policies change frequently. We are not responsible for retrospective changes implemented by governments or institutions after your application has been submitted.
Client Obligations & Integrity
A. Truthfulness of Information (Zero Tolerance Policy)
The Client warrants that all information and documents provided (Passports, Bank Statements, Educational Certificates, Work Experience) are genuine, accurate, and valid.
- Fraud Consequences: Providing fake, forged, or doctored documents is a criminal offense. If Alif Global discovers fraudulent documents, we reserve the right to terminate services immediately without refund and report the matter to relevant authorities if required by law.
B. Documentation Responsibility
- Passports: Must be valid for at least 6 months beyond the intended return date.
- Health: The Client is responsible for meeting all health entry requirements (vaccinations, PCR tests) for their destination.
Payments, Currencies & Refunds
A. Pricing & Exchange Rates
- Prices quoted in foreign currencies (USD, EUR, GBP) are subject to exchange rate fluctuations. The final charge will be calculated based on the exchange rate on the day of payment.
- Bank Charges: The Client is responsible for all bank transfer fees, intermediary bank charges, and credit card surcharges (typically 3-4%).
B. Refund Policy Strictness
- Consultancy Fees: Fees paid for consultation, file assessment, and application preparation are for work performed and are non-refundable, regardless of the application outcome.
- Third-Party Fees: Visa fees, University application fees, and Biometric fees paid to governments or institutions are never refundable.
- Travel Bookings: Refunds for flights and hotels are strictly subject to the supplier’s (Airline/Hotel) specific terms and conditions.
Limitation of Liability
To the fullest extent permitted by applicable law, Alif Global shall not be liable for:
- Visa Rejections: Any rejection, delay, or ban issued by an Embassy, High Commission, or Immigration Authority.
- Admissions: Failure to secure admission to a specific university or course.
- Indirect Damages: Loss of profit, loss of opportunity, or emotional distress arising from service delays or rejections.
- Travel Disruptions: Missed flights, lost luggage, or denied boarding due to incorrect travel documents held by the Client.
Maximum Liability: In any event, the Company’s total liability shall be limited to the Service Fee actually paid by the Client to Alif Global, excluding third-party costs.
Indemnification
The Client agrees to indemnify, defend, and hold harmless Alif Global, its directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from:
- The Client’s violation of these Terms or any law.
- The Client’s submission of false, inaccurate, or misleading information.
- Any negligent or willful act by the Client during a tour or application process.
Force Majeure
Alif Global is not liable for failure to perform its obligations due to events beyond its reasonable control, including but not limited to:
- Acts of God (Earthquakes, Floods, Cyclones).
- Pandemics, Epidemics, or Quarantine restrictions.
- War, Civil Unrest, Riots, or Terrorism.
- Government Bans, Border Closures, or Embassy strikes.
- Sudden Airline or Hotel insolvency.
In such cases, we will strive to offer credit notes or rescheduling options, subject to supplier policies.
Data Protection & Privacy
We respect your privacy and handle sensitive personal data (financials, biometric data) in accordance with global standards.
- Usage: Data is used solely for processing your specific service request (Booking/Visa).
- Sharing: We only share data with necessary third parties (Embassies, Universities, Airlines) required to fulfill the service.
- Retention: We retain records as required by law but do not sell data to marketing agencies.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of law, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect.
